TERMS OF SALE
The following Terms and Conditions apply to sales at www.parkerwatches.com (”the Web Shop”). You are instructed to read these Terms and Conditions before placing any orders. By approving an order, you confirm that you accept these Terms and Conditions. These Terms and Conditions may be updated by Philip Parker Watches in the future.
The Web Shop is intended for sales to consumers only. The Customer must be minimum 18 years old to order via the Website. If you are below the age of 18 you must gain parental approval before submitting any order through the Web Shop. Philip Parker Watches does not, in accordance with Swedish law, accept any credit purchases to persons below 18 years of age. Philip Parker Watches reserves the right to deny or change a Customer’s order (e.g. if the Customer has provided incorrect personal data and/or has any record for non-payment of debt).
A binding purchase agreement is concluded when your order have been confirmed by us (Order Confirmation). On rare occasions a certain product may run out of stock. If the missing item will not be replenished, the customer will be notified as soon as possible. Philip Parker Watches may propose an alternative product or if that is not possible or if such alternative product is rejected may have to cancel part of or the entire order. Philip Parker Watches reserves the right to cancel an order if fraud or similar activity, such as unauthorized use of another´s credit card, is suspected.
Philip Parker Watches shall have no liability in case products are sold out, nor for image or typographical errors on the Website, e.g. errors in the product description or technical specification, price adjustments (such as change in currencies) or incorrect information with regards to whether a product is in stock. While we aim at providing as accurate as possible descriptions and images on the Website, there may be minor color variations between the images and the actual products sold by us, due to a number of factors such as the color contrast configurations of your internet browser or computer monitor. All pictures are therefore to be seen as illustrations and are not guaranteed to reproduce the exact appearance of a product. Philip Parker Watches is entitled to rectify any such errors and, at any time, to change or update the information. If an inaccurate price has been stated for a product ordered by the Customer, Philip Parker Watches will naturally notify the Customer accordingly and await the Customer’s approval of the amended price prior to Philip Parker Watches continuing with the order process.
Philip Parker Watches recommends that the Customer creates a user account prior to making any purchases on the Website. When the Customer registers its user account and/or places an order, the Customer will be requested to provide some personal data. The Customer confirms that the information provided is correct and complete and is responsible for any errors in the information provided.
The Customer undertakes to ensure that no one, except the Customer, uses the Customer’s log-in details. The Customer may not disclose its username or password to any person and shall ensure that any documentation with information about username and password is kept in such a way that unauthorized persons may not access the information. The Customer shall notify Philip Parker Watches without delay if it may be suspected that any unauthorized person has obtained access to the Customer’s password. The Customer is responsible for all purchases made with the Customers log-in details if the Customer has not provided such notification.
If Philip Parker Watches suspects that the Customer abuses its user account or its log-in details or otherwise violates the Terms and Conditions, Philip Parker Watches is entitled to block the Customer’s access to its user account. Philip Parker Watches is furthermore entitled to assign new log-in details to the Customer. Orders made in another person’s name without his/her consent, or otherwise as a result of Philip Parker Watches suffer economic damage will be reported to the police.
PRICE AND PAYMENT
The prices at the Web Shop are current prices and may be changed at any time. Philip Parker Watches is not bound by price indications in the Web Shop which the buyer must reasonably or apparently understand are incorrect and which, for example, have occurred due to technical problems in the web platform or rates that have been manipulated by the customer. Prices are inclusive of VAT and are payable in the currency indicated at the Web Shop. For customers from Non-EU countries VAT will be reduced at the checkout. The prices do not include custom or local taxes nor payment- and shipping fees. The Customer can pay for its purchase in the manner specified on the Website. Payment can be made by credit card, debit card, PayPal or as may otherwise be instructed at the Web Shop. Philip Parker Watches reserves the right not to offer all payment methods at all times, alternatively change payment method if the payment method the Customer has selected does not work, for whichever reasons, at the time of fulfillment of the order. Please note that limitations of available payment methods are set forth on the Website. Where payment is subject to validation and/or authorization by a card issuer or bank or to credit validation, any Order Confirmation is subject to such validation or authorization. We co-operate with an authorized payment service provider (PSP), who processes your personal details in accordance with the international security standard PCI DSS, developed by international credit card companies such as VISA, MasterCard and Diners. All transactions will be sent through SSL (Secure Sockets Layer) in encrypted form and all card details and payment information will be protected and processed with a high level of security.
PAYMENT WITH BRAINTREE
Credit card information is not stored on our server, rather it is tokenized and stored on Braintree’s secure servers, which reduces our PCI compliance requirement. Braintree is a PayPal Company, PCI-complient and focus on providing a secure environment that goes above and beyond industry security standards and guidelines.
PAYMENT WITH PAYSON DIRECT (FOR CLIENTS FROM SWEDEN AND FINLAND)
Betalning sker enkelt och säkert med Payson. Även om du inte har ett Paysonkonto sedan tidigare kan du snabbt göra transaktionen via Payson. Payson samarbetar med VISA, MasterCard samt alla svenska banker som erbjuder direktbetalningar, Swedbank, Handelsbanken, SEB, Nordea och Danske Bank.

PAYMENT WITH PAYSON FAKTURA (FOR CLIENTS FROM SWEDEN AND FINLAND)
Om PaysonFaktura: Vi erbjuder betalsättet ”PaysonFaktura” i samarbete med Payson AB. Betalningsvillkor är 14 dagar och vid fakturaköp tillkommer en avgift om 10,00 kr. För att kunna beställa mot faktura måste Du ha fyllt 18 år och vara folkbokförd i Sverige samt godkännas i den kreditprövning som genomförs vid köpet. Fakturan kommer att sändas separat med e-post till den e-postadress du anger vid köptillfället. Vid försenad betalning skickar vi en betalningspåminnelse varvid lagstadgad påminnelseavgift om för närvarande 60 kr tillkommer. Vi debiterar även dröjsmålsränta med 2 % per månad från fakturans förfallodag. Vid utebliven betalning lämnas ärendet till inkasso varvid lagstadgad inkassoavgift om för närvarande 180 kr tillkommer. Payson förbehåller sig rätten att i enskilt fall neka leverans och ompröva beställarens kreditvärdighet.
Payson.seInformation om ångerrätt: Enligt Distans- och hemförsäljningslagen har Du som konsument (detta gäller ej företag) rätt att frånträda avtalet genom att meddela oss detta inom 14 dagar från mottagandet av varan. För att Du skall kunna nyttja din ångerrätt måste Du returnera varan i oskadat skick, i originalförpackning. Vid nyttjande av ångerrätten är det Du som står för returkostnaden.
Information om pantsättning: Vid betalning med PaysonFaktura kommer fakturan att pantsättas till Payson och därefter till SVEA Ekonomi AB, 556489-2924.
PROMOTIONS AND DISCOUNT CODES
All campaigns with reduced price are limited in time. Multiple offers can normally not be combined. A discount code or voucher is only valid once per customer and purchase. In case of obvious misuse of offers, such as coupons and promotion codes, the Web Shop reserves the right to cancel the order in question.
On orders eligible for a gift or discount the value of the gift/discount is considered as a general discount on the total amount of the order. If part of or the entire order is sent back for exchange or refund the value of the returned merchandise is recalculated and the purchase price minus the relative share of the overall discount will only be credited.
Promotions and discount codes are only valid on new orders and cannot be applied retrospectively.
We always aim at delivering your order as soon as possible. Normally orders of items in stock ship within 1-2 business days from Order Confirmation and can be expected to be delivered to you within five business days. Delivery times are estimates only and particularly during high season (e.g. Christmas) deliveries may take longer than normal. In case of a delay in delivery of more than fifteen (15) business days beyond the estimated delivery time above. The freight cost will be specified in the order summary before you submit your order. We currently ship to most countries but may not ship to certain countries outside the European Union. Should you have an inquiry as to whether or not we ship to a specific location, please contact our Customer Service. Please be advised that custom duty may be charged for any orders from outside the European Union. You are asked to inspect delivered items upon delivery and report any deviations found as stated under Returns below. In case you fail to collect your products upon delivery, we reserve the right to debit you a charge to cover our cost for return freight and administration.
In case of delay in delivery, Philip Parker Watches will notify you accordingly and will continue to monitor the order. Unless otherwise expressly agreed and if a delivery is delayed for more than 30 working days and it is not due to you as Customer, you are entitled to cancel the purchase. If any package shall be picked up at a specific delivery point, the Customer shall do so within the time specified in the notification. Packages shall normally be retrieved personally with valid identification and order number.
Philip Parker Watches is not liable for any delays caused by circumstances beyond Philip Parker Watches’ control, e.g. general labor dispute, acts of war, flood, fire, lightning, terrorist attacks, changed governmental orders, labor disturbance, prohibitions, restrictions, the company is exposed to criminal activity that affects activities, sabotage, poor transport or weather conditions, technical problems, defects in power- /tele-/computer communications or other communication and defects or delays in the service by sub-suppliers due to circumstances set forth above. Such circumstances shall result in relief from damages and other measures. If any such situation should arise, Philip Parker Watches shall inform the Customer accordingly both at the beginning and the end of the period for the current situation. If the situation has lasted for more than two months, both the Customer and Philip Parker Watches are entitled to terminate the purchase with immediate effect.
RIGHT OF WITHDRAWAL AND RETURNS
It is your responsibility to cancel the order in accordance with the conditions of sale. Cancellation after the order has been dispatched is not possible. In cases where the order has been dispatched, the customer is required to receive the order. Cancellation is not valid until the customer has confirmed with Philip Parker Watches either by email or telephone.
When purchasing products on the Website the Customer has a 14 day withdrawal period in accordance with applicable consumer protection legislation. This means that the Customer has the right to cancel any purchase by notifying Philip Parker Watches accordingly within 14 days from when the Customer or its representative received the product ordered (withdrawal period). In case you find that an item delivered by us to you is defective you should contact Customer Service as soon as possible with a formal complaint, to get a replacement delivery or, if that is not possible, a refund. The same applies in case you identify that a product has been damaged during transportation or you identify other deviations in the delivery, e.g. that the number of items or the product model delivered is not in line with your order. Philip Parker Watches is liable if the goods are damaged or lost in transit. Returns hereunder shall be sent to Support or to the other address specifically instructed by us. If we have included a return form in your delivery you should use such return form. In case of a return the risk (for loss or damage during delivery) is on the customer. Items purchased at other Web Shop or Wholesale Distributor cannot be returned through www.parkerwatches.com.
In connection with ordering a product for which the right of withdrawal does not apply, the Customer will receive clear information. If a product has been sealed, the Customer may not break the seal if the Customer wishes to utilize its right of withdrawal. The right of withdrawal ceases accordingly when the Customer breaks the seal. Defective products returned to Philip Parker Watches should be treated as if they were faultless. It is in all types of returns extremely important that the product is packaged in such a way that it cannot be damaged. Items shall be returned hereunder properly wrapped and packed in their original packaging in unused and saleable condition.
If the Customer wishes to withdraw a purchase, the Customer shall, prior to the expiry of the withdrawal period, send a clear message to Philip Parker Watches in the manner set forth here: the Customer shall provide its name, address and other relevant information, e.g. order reference, invoice number and the name of the product in the message.
As soon as we have received the returned items, and have been able to confirm that the requirements above are met, we will refund your payment. Philip Parker Watches will pay back the amount without undue delay, however, Philip Parker Watches may delay repayment until Philip Parker Watches has received the product or the Customer has provided proof that the product has been returned, e.g. by means of certificate of delivery. Repayment will be made to the Customer by the payment method chosen by the Customer, unless otherwise agreed or if there is any objection for such a repayment
Philip Parker Watches are crafted in our workshops and have undergone numerous stringent quality controls. Like any precision instruments, they require regular maintenance (cleaning, inspection of their regularity and verification of their water-resistance). Any servicing, restoration of the movement or checks must be performed exclusively by an official Philip Parker Watches service center. Each Philip Parker model is identified by a series number recorded in our archives.
Your Philip Parker watch is warranted for a period of one year from the date of original purchase from an authorized Philip Parker Watches dealer against any manufacturing defects under normal use, after such defects have been confirmed by our technicians. In the event of a fault covered by this warranty, we will, at our discretion and without cost, repair or replace any spare parts and/or rectify a faulty repair as identified by our Customer Service. All other rights resulting from the faulty execution of our services are expressly excluded. This limited warranty does not cover damage arising from normal wear and tear, accidents, carelessness (knocks, dents, crushing, broken crystal, etc.) or improper use. This warranty is rendered void if work is carried out on the watch by persons who are not authorized to do so by Philip Parker Watches.
The Philip Parker Watches warranty does cover:
- GTLS detaching from the dial or hands
- Hands falling off
- Manufacturing defects on the watch (Movement, case, crystal failure)
- Condensation or flooding when crown is fully in position (pushed in)
The Philip Parker Watches does not cover:
- Battery end of life, case, crystal, finishes and plating
- Damage resulting from improper handling, lack of care, accidents, loss, theft, or wear and tear
- Discoloration of light colored watches and/or components
- Damaged strap: wear & tear
- Failure or damage caused by fire or water, or a natural disaster such as an earthquake
- Esthetic changes that occur during normal wear and tear and aging (minor scratches, etc.; on the case and/or crystal, alteration of the color on the watchband and the peeling of the plating)
In order to use your warranty fill out our contact form on the « contact us » page. In the e-mail you need to specify your name, address, order number, watch serial number and a detailed description of the issue at hand. Then write ‘reclaim of purchase’ as subject of the e-mail and mail.
By submitting an order at the Web Shop you consent to us processing your personal data. Your purchase may involve the collection and processing by us, or by a sub-contractor of us, of your personal data, for example of the data you fill out in the order form, including your civic registration number as the case may be, or the personal data processing to meet our commitments to you in connection with your purchase, that may be necessary to execute your payment. We will use your personal data to manage your purchase (including with respect to payment, delivery and any returns and/or refunds), for marketing purposes and to improve the services and design of the Web Shop. We reserve the right to submit your personal data, in whole or in part, as may be required following a mandatory order of the police or prosecutor’s office or by a court of competent jurisdiction or another government agency having appropriate authority, including for the investigation of (suspected) fraud or other crime against you or a third party. Such disclosure will be limited to personal data that are relevant and/or necessary to meet such request and we will do our best to keep you properly informed of any such disclosure.
Your personal data will be stored only for as long as is needed or until you deregister or for as long as is provided by law. No matter what, your personal data will never be kept for a period longer than what is permitted in compliance with applicable personal data legislation. Upon your request, we will tell you which personal data about you we are processing and for what purpose(s) and you may request that your personal data is corrected or removed. In case you wish to be removed from any direct mailing lists, please contact our Customer Service. We will not sell your personal data to any third party for such third party’s marketing campaigns or for any unsolicited marketing unrelated to your purchase(s) at the Web Shop.
In order to protect the personal data that we process, we have implemented several security measures. We have implemented security procedures and technical and organizational measures to protect your personal data e.g. certification procedures for web browsers. We furthermore have sufficient firewalls and anti-virus programs in order to protect and prevent unauthorized access to the network. Physical access to the premises where the data is stored is limited and employees are required to be identified in order to gain access.
Philip Parker Watches furthermore uses e.g. SLL (Secure Socket Layer) which is a protocol for the safe transfer of data over the Internet (or other networks). As a customer, you need to check that SLL is not turned off in the settings of the web browser. With the purpose of preventing any unauthorized access upon processing you credit card number, one-way codes will be used.
COPYRIGHT AND TRADEMARKS
Philip Parker Watches owns the Website. Philip Parker Watches owns or has rights to all of the wallpaper, icons, characters, artwork, images, graphics, music, text, videos, software and other content of the Website (the « Content »), and all HTML, CGI and other code and scripts in any format used to implement the Website (the « Code »). The Content and Code of the Website are protected by copyright. Except as set forth herein, you may not copy, modify, upload, download, transmit, re-publish, display for redistribution to third parties for commercial purposes, or otherwise distribute any Code or Content from the Website without the prior written agreement of Philip Parker Watches. You may not use the Content or Code from the Website for any purpose other than those set forth herein.
All names, logos and trademarks which appear on the Website are the property of Philip Parker Watches. You may not use them in any manner which is likely to cause confusion or in any other way without the prior express written permission from Philip Parker Watches.
APPLICABLE LAW AND DISPUTE RESOLUTIONS
Any dispute regarding the interpretation or application of these Terms and Conditions shall be governed by and construed in accordance with Swedish laws and shall be exclusively settled by the courts of Sweden. In the event of any dispute, Philip Parker Watches complies with the decisions of the Swedish National Board for Consumer Complaints (www.kov.se).
